1. The Service
Cafe Solo provides Expresso, an app that helps people practice English through short daily sets of sentences, translations, and progress tracking. As an incentive for consistent practice, the Service may offer small, earned rewards as described in Section 4. We may add, change, or remove features at any time.
2. Eligibility
You must be at least [13] years old to use the Service. To earn or claim rewards, you must be at least [18] years old (or the age of majority where you live), or have the involvement and consent of a parent or guardian. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.
3. Your account
You are responsible for activity under your account and for keeping your access details secure. You agree to provide accurate information and to maintain only one account for yourself unless we expressly permit otherwise. We may suspend or close accounts that violate these Terms.
4. Rewards
Rewards are an optional incentive to encourage genuine learning. They are not wages, prizes from a sweepstakes, or an investment, and they have no cash value except as required by law.
How rewards work:
• Rewards are earned only by genuinely completing the learning activities and milestones we define in the Service.
• Rewards are limited in value and limited in number per person, and may include small coffee coupons or low-value digital gift rewards.
• Earned rewards are delivered through a third-party rewards provider to the email address associated with your account.
• We may modify, pause, or discontinue the rewards program, and we may change reward types and values, at any time.
Anti-fraud. Rewards are intended for real learners only. You may not create multiple or fake accounts, automate or fake practice, share or sell accounts, or otherwise attempt to obtain rewards you did not genuinely earn. We may withhold, revoke, or reverse rewards, and suspend accounts, where we reasonably suspect fraud, abuse, or a violation of these Terms. Reward delivery may also be delayed or subject to verification by us or our rewards provider.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to defraud the rewards program or interfere with its integrity.
- Access the Service using bots, scrapers, or automated means except as we permit.
- Attempt to breach security, disrupt, or reverse-engineer the Service.
- Upload harmful code or content, or infringe others' rights.
6. Intellectual property
The Service, including its content, branding (including the "Cafe Solo" and "Expresso" names and logos), text, and software, is owned by us or our licensors and is protected by applicable laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own learning. You may not copy, modify, distribute, or create derivative works except as expressly permitted.
7. Third-party services
The Service relies on third-party providers, including a rewards platform used to deliver earned rewards. Your use of a reward delivered through such a provider may also be subject to that provider's own terms. We are not responsible for third-party services, but we choose providers we consider reputable.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular learning outcome will be achieved.
9. Limitation of liability
To the fullest extent permitted by law, Cafe Solo and its owners and team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior twelve months (which may be zero) or [USD 100].
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
11. Changes to the Service and Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of [your governing jurisdiction — e.g., the Province of British Columbia, Canada], without regard to its conflict-of-laws rules.
